Judge UNSEALS probable cause affidavit in Delphi Bridge murders case

One of the Delphi Bridge murder victims shouted 'gun' as she spotted their killer advancing towards them - while an unspent round found close to the girls' bodies was 'cycled' through the suspect's gun, a probable cause affidavit claims.

The newly-unsealed affidavit alleges that Libby German, 14 and her friend Abigail Williams, 13, were murdered by Richard Allen, 50, near the Monon Bridge High Trail while he was kidnapping them on February 13, 2017.

It shares the final known words spoken by one of the girls - 'Gun,' before their killer ordered them 'Guys, down the hill.' Cops have yet to say whether Abigail or Libby made that outburst. 

The two girls were found dead near a creek the next day, with an unspent .40 caliber round found next to their bodies.

Authorities have charged Allen in the deaths of Abigail Williams, 13, and Libby German, 14

A breakthrough in the case finally came last month when cops were able to track down the pistol that likely fired the bullet to Allen's home less than two miles from the site. They say the bullet must have 'cycled through' his gun. 

Allen is now charged with felony murder in their deaths, with prosecutors claiming he had killed the two teens while trying to kidnap them. 

He has not, however, been charged with kidnapping. 

Chilling eyewitness interviews that comprise part of the probable cause affidavit suggest Allen was on the bridge waiting for his victims.

An eyewitness interviewed, who was on the bridge that day, recalled seeing the man believed to be Allen first while walking back along the same trail. They said he was  'kind of creepy' and appeared 'muddy and bloody' at the time. 

He was ahead of German and Williams, witness suggested, meaning he may have lain in wait for his victims. 

Meanwhile, Allen admitted to cops being in the area that day during an interview carried out in 2017, although he has long denied the murders. 

He said at the time that he decided to walk along the new Freedom Bridge, where he saw three females — saying one of them was taller and had brown or black hair.

Allen was then interviewed again on October 13, 2022, when he told investigators he had just gone on the bridge to watch fish — and once again insisted he did not interact with the teens.

He has pleaded not guilty to the murder charges, and has recently petitioned a judge to move his trial at least 150 miles away from Carroll County, citing over five years of 'intense publicity' in the case that gripped the nation. 

Authorities, meanwhile, say he may not have acted alone, while Allen's defense attorney, Andrew Baldwin, has insisted cops have the 'wrong guy.'

Baldwin has previously called the probable cause document 'flimsy,' adding: 'You expect more than what I saw.'

He and co-counsel Brad Rozzi have now filed a motion to move Allen's upcoming murder trial out of Carroll County.

'Although it could be argued that the amount of publicity that this particular case has received in the past 5+ years, will make it difficult to find a jury that has not heard of this case, Richard Allen's defense team has gleaned statistical data that would strongly indicate that moving the case/trial just 150 miles away would significantly reduce the likelihood of obtaining a tainted jury pool,' Rozzi wrote in the motion, filed Monday. 

Allen is scheduled to face a jury on March 20, with a bail hearing scheduled for February 17.

 In the meantime,  he is being held in state custody for his own safety, after a court order ruled that he was in 'imminent danger of serious bodily injury or death, or represents a substantial threat to the safety of others.'

Police reports seen by Fox59, revealed that officers were previously sent to Allen's home on June 18, 2015 at around 3.30am for reports of a 'domestic' incident.

Sheriff Tobe Leazenby said Allen, a dad-of-one and a CVS technician, was allegedly drunk, and his wife took him to a hospital for a medical evaluation.

Authorities confirmed that their role was to 'keep the peace' during the incident and no arrests or charges were filed.

But after news of Allen's arrest broke, a disturbing photo emerged showing his own daughter posing in the same spot where the teenage victims were last seen alive.

The photo was posted to Facebook by Allen's wife Kathy, 50, in 2018 —just over a year after the girls disappeared in February 2017.

It's unclear when the photo was taken and also no indication as to who took the snap on the Monon High Bridge Trail.

Authorities, though, say Allen may not have acted alone in the double homicide. 

In court last week, prosecutors revealed they have reason to believe he is not the only one involved in the killings, WTHR reported, though they did not mention any other names.

They said: 'We believe Richard Allen is not the only actor involved in this.'

Authorities have previously pegged Ron Logan, who died earlier this year, as the prime suspect in the homicides after the girls' bodies were found on his property.

An FBI investigation also concluded that the voice in a clip released by police of a man talking to the girls shortly before their deaths, was 'not inconsistent' with that of Logan.

He was arrested shortly after the killings, but he was released and never charged, even after it was discovered that his alibi for the day of the murder did not line up.

Kegan Kline, 28, of Peru, Indiana, was also previously named as a suspect in the murders by Indiana State Police, and was interviewed by cops.

He is said to have admitted to talking to Libby German using a fake Instagram profile called Anthony_shots.

Kline - who is heavy-set and pasty-faced - used an image of a ripped and muscular young man to trick underage girls into speaking to him.

He is said to have arranged to meet with Libby on the Delphi High Bridge the day before she was murdered while walking along it.

But he is also said to have shared his Anthony_shots password with others - including his father - and said his father could be a prime suspect in the killings.

Kline is being held in jail after being arrested on separate child porn charges in 2022.
