A junior at one of New York City's top public high schools was sexually assaulted by a classmate in the bathroom, who sent other students a recording of it.

The victim, identified as Jane Doe in a new lawsuit filed against the city and Department of Education, said the attack happened on November 4, 2021, at the prestigious NYC Lab School for Collaborative Studies. 

The 11th grader claimed the school failed to call police, with an assistant principal even grilling her about the video circulating the school, the New York Post reports.   

'Without regard to the status of [Jane Doe] as an underaged victim of sexual assault or her apparent emotional and psychological trauma, [the assistant principal] forced [her] to write a statement describing her sexual assault,' the lawsuit states. 

Her father, identified as 'Joe Doe,' claims the school knew his daughter was a victim of harassment in the past and that the suspect 'had a reputation for engaging in dangerous behaviors.' 

He also warned that the girl, who comes from an Islamic country in the Middle East, could be executed if she ever returns and officials learn about the assault.

According to the lawsuit, which was filed in the Manhattan Supreme Court last Friday, the suspect, identified only as 'N.R,' followed the victim to the first-floor bathrooms of the school. 

As he blocked the bathroom exit, N.R. 'demanded' that the girl give him oral sex, and when she refused, he forced himself on her, the lawsuit states. 

N.R. allegedly forced her into a bathroom stall, pushed her to the floor, and 'held the back of her head' during the assault, the suit adds.  

Following the assault, the victim said she found out N.R. had recorded the crime on his phone and was showing it off to other students. 

When assistant principal Jason Koch learned about the video, he allegedly pulled the victim out of class to question her about it without the presence of a school counselor. 

The lawsuit claims the school was negligent when it failed to protect the victim, noting that there were no security guards or monitors placed near the bathrooms. 

The suit also states that neither Jane Doe's family nor the police were notified about the assault when the school learned about it. 

The family is seeking unspecified damages and have requested to remain anonymous in court.  

Neither the school, Koch, nor the Department of Education immediately responded to DailyMail.com's request for comment.

Along with his outrage over the assault, Joe Doe said the school's negligence was evident after it failed to act when he asked that she be transferred to another school following an incident in 2019. 

The lawsuit says that Jane Doe had been the victim of bullying and a physical assault in 2019, but an assistant principal did not approve the family's request to move her to another school. 

NYC Lab School for Collaborative Studies, located in Manhattan's Chelsea neighborhood, is among the top five percent of schools in the Big Apple, according to Public School Review. 

The high school places in the top five percent of all schools in the state when it comes to math and reading proficiency, as well as overall test scores. 

The school also boasts a 95 percent graduation rate, well above the state's average 83 percent.
