Gwyneth Paltrow jury is sent out to reach a verdict in $300,000 ski crash trial

The jury has officially left the courtroom as they work to determine who is at fault for the 2016 ski crash and whether it caused Sanderson to suffer from irreparable brain damage.

Only six jurors have to agree on each question before they can move on.

Rebutting the defense case on behalf of Sanderson, attorney Peter Sorensen said: ‘There are two stories here. One is Gwyneth Paltrow’s. But there’s another side and that is Terry Sanderson’s. 

‘The two stories that are important to remember are Gwyneth Paltrow’s and Terry Sanderson’s. I will tell you that what you see in the record, corroborates Terry Sanderson’s. 

As the plaintiff once again sought to rebut the defense, lawyers argued that their animations do not show all of the events.

They noted that Brad Falchuk was not shown in the animation, nor does it include the testimony of instructor Kari Lake.

The defense argued in their closing arguments that Sanderson is still in good health and is not in as much cognitive decline as he says he is.

'Moving on, I think, would be good for him,' lawyers argued.

Owens co-counsel on Thursday sought to draw a line between Paltrow and Sanderson, painting the actress as truthful and the retired doctor as a liar.

'On the one hand you have real events, on the other you have embellishments,' he said, insinuating he was blaming Paltrow for his aging body.

Owens concluded his remarks on Thursday by saying 'This is a meritless claim.'

He said that someone who called Paltrow 'King Kong' does not deserve to just walk away.

Owens used his time on the stand to hammer Sanderson, telling the jury the retiree had owned a Go Pro but destroyed it after concluding the video on it wouldn’t help his case.

He referred to Sanderson’s youngest daughter Jenny, who said in her deposition her father would be ‘dishonest for money and notoriety’, and noted the optometrist’s own expert Dr Wendell Gibby had no idea of her existence.

Owens slammed eye witness Craig Ramone in his closing arguments on Thursday.

He noted that Ramone was still up the hill at the time of the crash, is color blind and has poor vision.

In his closing argument, Paltrow's attorney Stephen Owens noted that Paltrow had set up the ski trip to blend her and Brad Falchuck's families.

'They lost that because he hit her,' Owens said pointing first at Sanderson and then at Paltrow. 'He hurt her.'

Throughout the plaintiff's closing arguments, Gwyneth Paltrow looked displeased with what she was hearing.

At one point, she could be seen apparently laughing, while at other times she seemed in shock.

Recounting his opening remarks, Sanderson's lawyer says he is entitled to $3.3million.

He used a white board to show how, if Sanderson had 10 years left to live, he should be compensated more than $3.2million for the loss of his facilities.

'Our time on Earth is one of the most valuable things we have,' Sanderson's lawyer told the jury, noting 'Terry's in the last days of his life.'

He said he believed Sanderson only has about 10 years left, and 'these are his golden years, when you can actually enjoy your retirement and travel.

'But now he has to travel with other people to avoid getting lost.'

Another lawyer for the plaintiff claimed in his closing arguments that Sanderson had a concussion that lasted more than a year and a half, citing expert testimony.

He said that the defense's experts who testified otherwise never actually saw Sanderson in person.

Sanderson's lawyer said the biggest piece of evidence the jury must consider is a 'sudden and precipitous' change in the retired optometrist's behavior.

He also noted that all of the experts 'admitted he had a concussion,' and said Dr. Fong believes 5 to 20 percent have permanent issues.

'Part of Mr Sanderson will always be on Bandana Run' he argued. 'We hope you will bring Terry home with a fair verdict today.'

In his closing argument, Sanderson's lawyer once again argued that the ski resort covered up the crash.

He pointed to witness testimony of Sanderson saying he was OK, despite suffering from broken ribs at the time.

'Now that's just unbelievable,' he said.

In starting his closing arguments, Sanderson's lawyer Robert Sykes said he does not think Paltrow nor Sanderson are lying.

He recounted how he watched a car crash recently, and noted that 'sometimes people who are in these incidents have a different point of view.'

Under the judge's instructions for the jury, he said that only six jurors must agree on each question before they move forward.

Once any six jurors agree on a subject, the jury is to move forward onto the next question.

During cross examination, Dr. Boehme acknowledged that Sanderson could not have flown into the air as he claimed.

He said Paltrow would have had to be traveling at 50 to 60mph for that to happen, according to his version of events.

In his testimony on Thursday, Boehme used math to prove that 'the object that fell on Mr. Sanderson had to weigh more than 100 pounds.'

He said the only way Paltrow's version of events could have happened, is if they both rotated at a speed of 400-degrees per second — which eh said not even Olympic divers can do.

When the plaintiff tried to once again call Dr. Richard Boehme to the stand to dispute claims that his math was incorrect and Sanderson's version of events would not have resulted in the type of injuries he has claimed, the Zoom video was not working.

Paltrow's tried to strike his testimony, arguing they could only hear every fourth word, but the plaintiff decided to switch to a phone call, figuring that could work better.

It seemed to work for a while, but the call soon dropped.

At the rate they were going, Paltrow's attorneys argued they may not have time to cross-examine him before closing arguments.

But they were eventually able to get Boehme to testify over cellphone.
