A Delta Airlines first-class passenger was arrested after he was accused of forcing himself on a male flight attendants and kissing him on the neck.
David Alan Burk, 61, was flying from Minnesota to Alaska to settle his dead friend's estate when he allegedly got 'wasted' on a Delta flight 517 on April 10.
Burk told the flight attendant he was 'so beautiful' before asking for a kiss. When the man declined, Burk allegedly grabbed him and planted a kiss on his neck.
He allegedly grew 'snippy' when he was refused a glass of red wine and later on in the flight managed to smash the captain's meal tray.
The flight attendant, referred to only as TC in court papers, had to be moved to the back of the plane for the rest of the six-hour journey while other cabin crew tended to Burk.
David Alan Burk, 61, was allegedly traveling to Alaska to settle his dead friend's estate when he got drunk on a Delta flight 517 and forced himself onto a flight attendant - who was only identified at TC in court documents - kissing his neck and telling him he was 'beautiful' on April 10
Burk had preordered a glass of red wine prior to boarding the aircraft, as is allowed for first-class passengers, but grew frustrated when TC did not serve him the drink prior to departure due to the flight's catering arrival moments before.
After departure, TC prioritized getting Burk his drink, but while collecting meal trays, he grew wary of Burk, who 'shook his hand.'
Ten minutes later, Burk would approach TC in the gallery and told him he was 'so beautiful' before asking him: 'Can I have a kiss?'
TC replied: 'No, thank you,' but Burk did not take no as an answer, grabbing the flight attendant by the neck and telling him: 'Okay, well on the neck then.'
'While the plane was in flight, BURK then grabbed TC's neck, pulling him toward BURK, and purposefully kissed TC's neck,' the affidavit, obtained by the Daily Beast, stated.
The flight attendant said he was 'very uncomfortable' and 'caught off guard' by the bold move. As Burk moved toward the bathroom, he looked over his shoulder at TC and said: 'I have one of those Delta cards for you.'
Delta cards are given to 'frequent flyers to give to Delta flight attendants who the frequent flyers believe deserve to be recognized and rewarded for their good work.'
Attendants can cash the cards in for rewards, such as a higher-flying status when they're flying Delta as passengers.
TC told investigators that he thought the compliment was 'genuine,' but that Burk's 'actions and demeanor escalated so quickly.'
TC moved to the back of the plane to tell his coworkers about the encounter and did not return to first-class until after Burk retook his seat at 5A.
Upon returning to the front of aircraft, other flight attendants informed TC that Burk had 'broken the tray and plate containing the captain of the plane's meal.'
TC then contacted the Captain, who was only identified as JS. The captain later informed his crew member that he had contacted Airport Dispatch about the incident and that this was a 'level two security threat' and a flight attendant would have to switch roles with TC.
A flight attendant who switched places with TC said the man was 'wasted' and had drunk three glasses of red wine while on the flight. Burk would later denied it, saying he only drank one glass, which was served by TC, before falling asleep. He was booked into the Anchorage Correctional Complex and released on his own recognizance on April 13
'[TC] felt uncomfortable by the situation and requested to be moved to the back of the plane to put distance between he and [Burk],' JS said in a statement to investigators.
However, other flight attendants 'did not feel comfortable' serving Burk either and one refused to switch places due to fears of what he would do to her. Another female attendant would eventually switch places with TC.
As the flight continued, Burk would consume two more glasses of red wine and become 'wasted' before falling asleep, a flight attendant told TC, according to the affidavit.
Upon arrival in Anchorage, Burk was taken into custody by Airport Police and was read his Miranda Rights. While talking to investigators, he denied ever getting up to use the restroom, but had confirmed TC was his flight attendant and his only flight attendant.
He did, however, deny consuming three glasses of red wine, saying he only drank the first one that TC served him after departure and that he slept the rest of the flight.
When he was asked if he had kissed the flight attendant, he said he 'never kissed anybody.' He also said he 'didn't even eat on the flight' and denied breaking the tray table because he didn't 'recall going to the bathroom at all on that flight.'
He then told investigators he had 'a lot' of alcohol prior to the flight, but maintained that he only had one glass of red wine on the aircraft from Minneapolis to Anchorage. He also refused to take a breathalyzer test as he did 'nothing wrong.'
Burk also told investigators he was in Anchorage to deal with his friend's estate as he was an executor and that his friend had died the week prior.
He asked police: 'Do you know who I am?' They did not.
He was booked into the Anchorage Correctional Complex and was released on his own recognizance on April 13.
