A CVS worker charged with stabbing a serial shoplifter to death in a Midtown Manhattan store has been freed after posting a $100,000 bail. 

Scotty Enoe, 46, had been held in custody at Rikers Island following the brutal knifing of Charles Brito, 50, in Times Square in the early hours of July 6. 

The alleged killer is now back on the streets after a judge slapped a slew of restrictions on his movement, including limited outdoor time and an 8pm curfew. 

His attorney, Adam Freedman, said: 'Obviously he's happy to be getting out of jail. He's looking forward to being home and he's looking forward to going back to work'. 

Enoe is facing several criminal charges including murder and criminal possession of a weapon, and is expected back in court September 7.

After picking up his belongings in a clear plastic bag, the 46-year-old was seen walking the streets of the Big Apple immediately after posting bail. 

Dressed in a white t shirt and chinos, Enoe strolled from the authorities to a park in New York, where he clutched his clothes and stared hauntingly ahead.

He suffers from sickle cell anemia and works a number of jobs alongside pulling shifts at CVS, but was told he could continue to work so long as he stuck to the conditions placed on him by Judge Laurie Peterson.

Enoe was forced to surrender his passport and agreed to stay in the five boroughs of New York, but will be allowed to work between 7am and 6pm. 

He must be back home by 8pm, and has been granted just two hours of outdoor recreation time a day. 

'I really appreciate the fact that they recognize this as not your run-of-the-mill kind of case, and that this guy should not be in jail pending some sort of resolution of it,' Enoe's attorney Freedman told the New York Post

'So we’re pleased that he’s going to be getting out today.

'He’s got a chronic illness, and he was getting medical attention for it, so at least from that perspective he’s happy and we’re pleased, and his health seems to be OK,' Freedman added. 

'But obviously he’s going to get much better attention and care in the community than he ever would with the Department of Correction.' 

Court records reportedly showed Enoe's $100,000 bail was paid by Big Geyser, a Queens beverage distributor, and it was posted by celebrity bail bondsman Ira Judelson.

Enoe is charged with fatally stabbing serial shoplifter Charles Brito after they became embroiled in a fight in a Times Square CVS. 

The early hours brawl erupted between 49th Street and Broadway, with Enoe's mother claiming Brito instigated the violence.

'The guy came in and started arguing with Scotty. Next thing you know, Scotty was on the ground. He acted in self-defense,' the suspect's mother, Lucille Enoe, told the Daily News.

'When the guy threw him down and started beating him up, Scotty stabbed him' the 72-year-old explained.

Police said the fight broke out after Enoe attempted to stop the vagrant from stealing Gatorade and a container of creamer at around 12:30am.

After being punched, Enoe allegedly whipped out a knife and fatally stabbed the man in the torso. 

Police were called to the scene for a reported robbery-in-progress, but the stabbing had already taken place when they arrived.

Cops later said they found a blood-soaked knife and brass knuckles on Enoe after he was arrested and taken into custody. 

Brito was rushed by Emergency Medical Service to NYC Health and Hospitals Bellevue where he was pronounced dead, leading Enoe to be charged with murder and criminal possession of a weapon.

Brito, who was homeless, had more than a dozen previous shoplifting arrests to his name and was known to target drug stores in Upper Manhattan.

A police source told the Post that targeting drugstores like CVS and Walgreens was Brito's 'MO', and the shoplifter was even due to be sentenced a week after his death for a number of other offences. 

Brito had a lengthy rap sheet with 16 unsealed arrests, including just a week before his death, when he was apprehended on a petit larceny charge after stealing four Monster energy drinks and seven Starbucks Frappuccinos from a CVS store in Upper Manhattan on July 2.

He then returned to the store two hours later, this time with a suitcase to make off with an even larger haul.

That time he got away with a stash of Oreos, Pepsi, M&Ms, Hershey's Kisses and another pack of Starbucks drinks - all totaling $125.

On another occasion he ventured into a CVS in Upper Manhattan last month to steal a load of energy drinks from the fridge only to return hours later to steal more of the same.

He was charged with petit larceny charge with bail set at $5,000. He was set to be sentenced to three years' probation after taking a plea deal that combined the two earlier incidents together.
