The mother of a 13-year-old boy who was 'raped' by an Ohio social worker counseling him is now suing, claiming she told the worker's agency about their inappropriate and illegal relationship but they allowed it to continue.
Payton Shires, 24, is currently in jail awaiting her next court date on multiple charges of sexually assaulting the boy.
She is said to have admitted to their inappropriate relations on phone calls with the boy's mother.
The alleged victim's mom found inappropriate text messages between the pair which led police to discover a deleted video of them having sex.
Shires, who has also been charged with intimidating a witness by force of threat, had a $50,000 bond she had been out on revoked, and is now expected to remain behind bars. She is said to have had sex with the the teen she had been tasked with counseling at least twice in September
Now, the mother is suing The National Youth Advocate Program, claiming she was ignored when she reported the relationship in September.
The mother, who has not been named publicly to avoid identifying the underage male victim, is now seeking $50,000 in damages.
She claims the NYAP had the power to remove Shires from her son's case but failed to.
'We think they dropped the ball in this case,' the mother's attorney said.
Shires was arrested on October 6 then posted bail.
She was rearrested a short time afterwards after going to the family's home armed with a gun which she pointed at her own head, threatening to kill herself and the boy's mother who she said had 'ruined her life'.
She denied threatening the mother at her last court appearance.
