Former Trump White House trade adviser Peter Navarro has made a last ditch appeal for his four-month contempt of Congress sentence to be delayed after being told to report to federal prison next Tuesday.
His legal team said it was prepared to take his case all the way to the Supreme Court as it argues that executive privilege meant he did not have to cooperate with Congress and its investigation into the January 6 attack on the U.S. Capitol.
In a Sunday night filing, his lawyers revealed that the 74-year-old had been told to report to prison in Florida on March 19.
That could make him the first high-ranking official from the Trump White House to serve time in connection with efforts to overturn the 2020 election result.
Navarro told DailyMail.com that he was the victim of a partisan attack.

'United States v. Peter Navarro is a landmark constitutional case that will eventually determine whether the constitutional separation of powers is preserved, whether executive privilege will continue to exist as a bulwark against partisan attacks by the legislative branch, and whether executive privilege will remain, as President George Washington pioneered, a critical instrument of effective presidential decision-making,' he said.
'That's worth fighting for on behalf of all Americans.'
Time is running out, as his lawyers point out in their latest filing.
'Dr. Navarro has now been ordered to report to the custody of the Bureau of Prisons, FCI Miami, on or before 2:00PM EDT on March 19, 2024,' wrote his lawyer Stanley Woodward.
Federal Correctional Institution, Miami, is a low-security prison for men. Notable current or former inmates held amid its lush green lawns and palm trees include former dictator of Panama Manuel Noriega, Bill Campbell, the former mayor of Atlanta who served two years after being convicted of tax evasion, and Joel Greenberg, the associate of Rep. Matt Gaetz, convicted on sex trafficking, identity theft and wire fraud charges.
Navarro was found guilty of contempt of Congress last September. He refused to sit for an interview or hand over documents to the Democratic-led House committee that was investigating the Jan. 6 violence.

The Department of Justice took up the case and he was sentenced to four months in prison in January.
His lawyers argued that former President Donald Trump used the legal concept of executive privilege to prevent disclosure of sensitive information.
But the federal judge in his trial decided that Trump had not invoked the privilege.
Congress also referred the cases of former White House strategist Steve Bannon, former chief of staff Mark Meadows and deputy chief of staff for communications Dan Scavino to prosecutors.
Bannon was the only one prosecuted.
He was convicted on two charges and sentenced to four months in prison with a $6,500 fine. The sentence is on hold while he appeals.
