The Department of Justice is seeking four to 10 months of prison time for the woman who stole the diary of President Joe Biden's daughter, Ashley Biden, and sold it to a conservative news site for thousands. 

Aimee Harris stole the diary while staying at Ashley Biden's Delray Beach, Florida, residence in 2020. She later asked Robert Kurlander to help her sell the stolen material.

The pair later sold it to Project Veritas, a conservative news outlet, for $20,000 each, according to the Department of Justice (DOJ). Both pleaded guilty to conspiracy to commit interstate transportation of stolen property in August 2022, a crime that carries a maximum penalty of five years in prison.

However, the DOJ originally only sought six months of home confinement for Harris. 

But now, federal prosecutors want to see prison time on the table, and recommended four to 10 months would be an appropriate sentence in a letter sent to a New York federal court Tuesday.

The DOJ now wants to see Harris face prison time because she repeatedly produced excuses not to attend court hearings despite her necessary attendance, the agency argued in the letter.

Prosecutors say that Harris had inadequate excuses for the delays, which amounted to 12 in total. 

Harris, for example, delayed a hearing because she claimed she could not find child care. 

But federal officials later discovered that her husband was available to watch their children. 

She also delayed proceedings claiming to be sick, but she was unable to produce medical evidence of her ailments requested by the court. 

Further, prosecutors expressed annoyance at Harris' inability to secure identification documents that are required to travel, as she was mandated to travel from her home in Florida to New York for proceedings.  

'The defendant knew full well that she could not travel without appropriate identification,' the prosecutors wrote. 

'Thus, her failure to obtain such documentation evidenced a willful intent not to appear, and to manufacture a new excuse on the eve of each sentencing date.'

'This conduct is troubling, but unsurprising, given that it is entirely consistent with her history of disrespecting the judicial system.' 

Ashley Biden's diary contained personal documents including tax records, family photographs and personal contact information, according to the DOJ. 

Though Project Veritas never published the material, it was later posted on another right-wing website. 

The FBI previously raided locations tied to Project Veritas while investigating the matter

Prosecutors argued the harsher recommendation 'would send the message that breaking the law and then failing to abide with the orders of the Court during the pendency of a criminal case will not be tolerated and will have serious consequences.'

'Moreover, a sentence involving no period of incarceration would be wholly insufficient to reflect the gravity of the defendant’s conduct, including her apparent belief that she is above the law and that she need not comply with this Court’s orders.'
