The owners of a Florida beach house that has been left tilting at a precarious angle following a January tornado, are being sued by their neighbors after all three homes were deemed unfit to be lived in. 

The $1 million, three-story Panama City Beach home now appears to be resting on the houses next door, but the owners are refusing to tear it down, according to a complaint filed earlier this month.

Gene P. Stienecker and William Lawrence III who are both neighbors are unable to live in the homes, nor fix the 'extensive' damage caused by the property.

The homeowners have looked to have the home demolished but a planned demolition scheduled for March 4 was stopped from happening, a legal complaint states. 

The home has been left leaning since the storm hit overnight on January 9, but the owners James Sturgeon and Yik Chun Wu, who have owned the Panama City Beach property since 2014, believe they not legally required to remove it under Florida law.

The lawsuit, seen by the Miami Herald sees the neighbors suing Sturgeon and Wu — and seeking an injunction that will require them to remove their home.

They are also requesting damages of more than $2 million which would be decided by jury.  

'Stienecker and Lawrence have done all they can to try to get this property removed so they can get on with their lives while trying to protect themselves in the event additional damages occur in this process,' attorney Rebecca Gilliland said in a statement.

'The lawsuit is simply an 'attempt to try to get this matter resolved and hold (Sturgeon and Wu) responsible for the damage caused by their fallen structure.'

Both of the homeowners live in Georgia and don't live in the beach homes on a permanent basis.

The home was built in April 2018 and tipped over and fell once before after Hurricane Michael struck in October of that year.  

It was the first Category 5 on record to impact the Florida Panhandle.

The home 'has caused repeated and ongoing damage to plaintiff's properties,' the complaint states. 

The county could now levy fines against all three homes or seek to have them demolished.
