In 2022, two fans sued the company after they used actress Ana in a trailer for the 2019 movie Yesterday but cut her from the film.

Peter Rosza and Conor Woulfe, two dedicated fans, sued Universal Pictures in 2022, claiming they had spent $3.99 to rent Yesterday after seeing the actress in a trailer.

Despite appearing in the trailer, her role was cut entirely from the film, leading Rosza and Woulfe to sue the studio for $5 million for false advertising.

Rosza and Woulfe scored one legal victory, with a judge allowing the case to move forward in December 2022 and it has now been settled.

No terms of the settlement were disclosed and it's unclear if any money actually changed hands, despite the huge amounts both sides were asking for.

The film Yesterday was released in 2019, following a struggling musician named Jack (Himesh Patel) who is hit by a bus one day.

While scenes shot with de Ana were used in the trailer, director Danny Boyle ultimately decided to cut the character altogether after her arc failed to connect with test screening audiences. 

Ana did not appear in the finished film, which earned a solid $154.6 million worldwide from a $26 million budget.

Despite this legal victory, allowing the case to move forward, the class action lawyers failed to provide any data that would comprise an actual class for the lawsuit.

Then in August 2023, a judge dismissed the class action status, meaning the false advertising case could only move forward with the two plaintiffs - dropping the case's value from a prospective $5 million down to $7.98 - the cost of the rental fees.

The studio then filed a motion to have the plaintiffs cover the studio's legal fees, which they calculated to $672,000, though offered a, 'generous' deduction to $472,000.

The judge knocked it down even further to $126,705, with Universal offering to settle, though the plaintiffs' lead attorney, Cody R. LeJeune, hinted at still fighting.

He filed multiple discovery requests, while his former co-counsel, Matthew A. Pequignot, filed a settlement proposal of his own, stating his clients would drop the lawsuit for a $750,000 lump sum payment.

Universal's lawyers were not amused, with Stephanie Herrera writing, 'The attorneys who filed and sunk two years into this frivolous case are trying to pressure Universal into making a huge monetary payment (with no legal or factual basis) to end a case that is now worth $7.98.'

She then asked the judge for another $43,000 for 'abuse of the discovery process,' with a hearing that was set for April 30, and the trial set to start May 21.

Both parties filed a joint notice of settlement on Friday with the case believed to be fully dismissed in April
