California man struck and killed by train is identified after video showed homeless man eating his severed leg

A man who was killed by a train in California in an accident which severed his leg has been identified after a man was arrested for interfering with the limb. 

Horacio Ayala Peñaloza, 48, died after being struck by an Amtrak train which instantly killed him in Wasco in March of this year. 

Peñaloza died from multiple blunt force head injuries, with his death ruled an accident, according to a coroner's office report obtained by KBAK

Following the incident, stunned onlookers filmed video of homeless man Rosendo Tellez, 27, picking up the severed leg. Witnesses claimed they saw Tellez sniff the limb and wave it around, before attempting to eat it.

Following the reports and an investigation by the coroner as well as police, Tellez pleaded no contest in April to four charges, including two counts of removal of human remains from other than a cemetery and destroying/concealing evidence.

He was sentenced to one year in prison. Tellez also faced additional charges of bringing contraband into a jail facility. 

According to documents filed by sheriff's investigators, Tellez picked up the leg from the accident scene because he thought it belonged to him. 

'Tellez said after the train stopped (and) before deputies arrived, he saw the foot on the ground and thought it was his foot,' an investigator stated. 

'Tellez told me he picked up the foot to take to the hospital, but he got scared and ran when people in the area started yelling at him.'

The deputy saw Tellez had both his legs and then continued looking for the victim, KGET reported.  Another video from the scene shows Tellez sitting on a cub with his pant legs hiked up as he is being convinced by an officer he had both his legs.

He was seen bending over and pressing his nose against the leg - appearing to smell it - and swinging it around as officers closed in on the sickening episode.

A work crew laying concrete near the station watched the seen unfold, with worker Jose Ibarra telling WPDE of the alleged cannibalism. 

Ibarra told the outlet: 'I'm not sure from where, but he walked this way and he was waving a person's leg.

'And he started chewing on it over there, he was biting it and he was hitting it against the wall and everything.'

A GoFundMe was created to help the Peñaloza family cover funeral costs and raised just over $1,000.

Tellez was apprehended by police without resistance. Authorities discovered he had outstanding warrants for his arrest.

Burlington Northern Santa Fe, the involved railroad company, confirmed one of their trains was involved in the collision. 

According to their preliminary findings, Peñaloza was standing on the platform when he was struck by the train.
