A 77-year-old Oakland man has been arrested after he shot and killed a suspected burglar.

Police say two men and a woman pulled up outside the man's home in a stolen vehicle on Monday evening. 

One suspect was allegedly holding a crowbar as the three headed inside the man's home, as reported by KTVU

The homeowner, who has not been publicly named, apparently shot one of the men, the woman in the group told officials.

He was pointing the gun at the woman when police arrived, per officials.

The third suspect was found at the scene with a replica gun and was arrested on suspicion of burglary. 

The homeowner has been detained on suspicion of murder while the Alameda County District Attorney's Office considers whether to file charges. 

Police say the weapon used by the homeowner, a Colt Python revolver, was stolen.

Prosecutors have until Thursday to decide whether they will charge the homeowner, who has reportedly declined speaking with detectives.

It comes after an East Oakland resident shot and killed robbery suspect Charles Calloway in March.

Calloway's accomplice David Washington was charged with the murder, even though it was the homeowner who pulled the trigger, as reporter by sfist.

The homeowner was also shot, in the foot, during the gun battle with the suspects. 

The DA is pursuing the charges against Washington, arguing he provoked the homeowner to fire the shot that killed Calloway. 

California law saws homeowners can use lethal force if they believe they are being threatened in their home.
