Gypsy Rose Blanchard may have embroiled herself in a new legal drama after it emerged that she could be forced to list ex Ryan Anderson as her baby's father on the birth certificate.
The media personality, 32, announced on July 9 that she's expecting a baby with her current boyfriend, Ken Urker, with a due date around January 2025.
This would put the date of conception around April.
Gypsy filed for divorce from her Ryan on April 8 shortly after they publicly announced their split - but the divorce proceedings are still underway.
And Louisiana law states that she may have to name Ryan on the birth certificate if she is still legally married to him by the time the baby arrives.
Gypsy Rose Blanchard, 32, may be forced to list ex Ryan Anderson as her baby's father on the birth certificate
While Gypsy is insisting that the father of her baby is her current boyfriend Ken Urker (pictured together), thanks to a Louisiana law, Ryan gets default paternity if they aren't divorced when the baby arrives
Gypsy reportedly reconnected with Ken, who she had previously been involved with while she was in jail, around this juncture.
While Gypsy is adamant that Ken is the father, the fact that she hasn't yet finalized her divorce from Ryan could put the legal paternity of her baby in jeopardy.
That's thanks to an archaic law on the books in Louisiana - where Ryan and Gypsy filed their marriage certificate.
The law dictates that a mother's husband is automatically listed as the father on the birth certificate, regardless if the couple have been separated.
'If the mother is married to someone other than the biological father when the child was conceived or has been divorced for less than 300 days at the time of birth, the husband/ex-husband shall be the presumed father, unless paternity is established for the biological father,' explained one overview of the law.
Louisiana-based family law attorney Beau Brock spoke to People about the legalities surrounding a situation such as Gypsy's.
'There's a legal presumption in Louisiana that if you have a child while you're married, it's presumed to be the husband's child. It's done that way to protect the child,' said Brock.
'All the laws in Louisiana concerning paternity are designed to protect the child and make sure the child has a father and a mother to provide for them.
Ryan and Gypsy (pictured together) tied the knot while she was behind bars in 2022, and seemingly started married life together upon her release on December 28, 2023
Gypsy ultimately filed for divorce from Ryan (pictured) in April after announcing their split in late March - and from there seemed to quickly rekindle things with Ken
'So that presumption can be overcome by DNA and that's what people have to do.'
Unless Ryan signs an affidavit stating that Ken is the father, paternity will be his by default - which includes the baby getting his last name.
Gypsy was released from prison on December 28, 2023 after serving seven years for her role in the 2015 murder of her mother, Dee Dee Blanchard.
Through Dee Dee, Gypsy was a victim of Munchausen syndrome by proxy, with Dee Dee fabricating that her daughter had a series of ailments, including leukemia, and subjecting her to myriad unnecessary treatments.
Gypsy had tied the knot with Ryan in July 2022 in a prison wedding, and consummated the marriage with him shortly after her release.
Prior to getting into the relationship with Ryan, Gypsy had become involved with Ken - again, from behind bars - after he'd written a letter to her, inspired to contact her after watching a documentary about her life.
Ken proposed to Gypsy in 2018, but the pair broke things off sometime after that - a split that reportedly left Gypsy heartbroken.
Of the baby she's now expecting with Ken, Gypsy has stated that she does not want her child growing up in front of the camera.
She also launched a baby registry through her Instagram, but has since set it to private after it was inundated by trolls.
