Mushroom deaths: Sad detail revealed in will of alleged poisoning victim Gail Patterson in Leongatha, Victoria

Heartbreaking new details have emerged from the will of alleged mushroom poisoning victim Gail Patterson, one year after she and two loved ones died.

The former school office worker and her husband Don, both 70, and Gail's sister Heather Wilkinson, 66, all died within days of eating an allegedly poisonous beef wellington lunch at the home of her daughter-in-law Erin Patterson July 29 last year.

Erin Patterson was arrested at her home in Leongatha, in Victoria's Gippsland region, last November and was charged with three counts of murder and five counts of attempted murder. 

Court document lodged in the Supreme Court state that Don Patterson was to be the only beneficiary in his wife Gail's $212,679 estate, the Herald Sun reported.

But as he also died after the alleged poisoning, her assets will be equally divided between their three sons Simon, who is Erin's estranged husband, Matthew and Nathan Patterson and their daughter Anna Terrington. 

They will get an extra $53,239 each on top of the $650,000 each they recently were awarded from their father's $2.6million estate.

It also emerged that Nathan and Anna had to prove their father was dead, despite his probate having already been granted.

Their mother's death certificate showed she died on August 4 last year, a day before their father died.

Because Don did not survive his wife by 30 days, this triggered a review by Victoria's Supreme Court.

'The probate office has reviewed your application. The following further information is required,' an email read.

'File a supplementary affidavit of executor clarifying the situation of the instituted executor 'Donald Kenneth Patterson'.

'The current affidavit of executor and the advertisement contain inconsistent information.'

Erin Patterson, who is awaiting trial, was left nothing in the will.

In Gail's will dated November 2, 2018, her assets were valued at $212,679.

This included more than $176,000 in shares, a $30,000 Kia wagon and a $5000 Holden wagon.

As her will has now been granted probate, the executers, Nathan and Anna, can divide the assets between the beneficiaries.

The affidavit of the executor document said 'the full death certificate showing the cause of death has not as yet been finalised, as the death of the deceased is subject to a coronial enquiry'.

The meal eaten by the three people who died, which was cooked by Erin, allegedly contained death cap mushrooms.

The attempted murder charges relate to Heather's husband Ian Wilkinson, who ate the meal but recovered after spending two months in hospital, and Simon, who was due to attend the lunch but pulled out at the last minute.

The other three attempted murder charges also relate to Simon, in the locations of Korumburra, Howqua and Wilsons Promontory, in November 2021, May 2022 and September 2022.

Patterson is due to face court later this month.
