A gas station clerk in San Bernardino was tasered and beaten by baton-wielding cops after they arrested the wrong man.

Video footage from both a body camera and a cell phone captured a San Bernardino police officer striking a gas station clerk with a baton 16 times. 

The violent incident, which occurred on June 6 outside a Kwik Stop Food Market, left clerk Billy Hill with two broken legs, according to his attorney.

'We have to expect better,' attorney Dale Galipo told CBS News. 'This is not a guy who had a weapon or was trying to hurt someone, threatened or attacked someone. The guy worked there 

Police were initially searching for a motorcycle crash suspect matching Hill's description, but his lawyer insisted his client was not involved.

The 911 caller described the hit-and-run suspect as a white man wearing a black hat, black shirt, and possibly blue jeans.

However, Galipo, maintains that his client was wrongfully identified and was not involved in the motorcycle crash.

Officers who arrived at the scene claimed Hill was speaking erratically, and told law enforcement his motorcycle was locked up in his house.

The police, who claimed Hill was not cooperating with him, attempted to put the clerk in handcuffs.

A third officer joined the fray, and as the officers grappled with Hill, one drew a taser.

In a desperate attempt to defend himself, Hill kicked out at the officer and tried to grab the taser.

When the taser proved 'ineffective,' the officer resorted to using a baton, striking Hill's legs multiple times while other officers restrained him.

'He then made the choice to continue to resist arrest, which furthered the escalation of force to the point officers utilize the baton.' 

Bystanders at the scene reacted with shock, shouting references to the infamous Rodney King beating by Los Angeles Police Department officers in 1991. After the assault, Hill was arrested for resisting arrest.

The department said Hill is a convicted felon with a lengthy criminal history, which includes prior convictions for possession of a stolen vehicle, resisting arrest and resisting arrest by means of force. 

The San Bernardino Police Department has launched an internal investigation into the incident and acknowledged public concern.

Chief Darren Goodman pledged transparency and accountability in the process and is investigating the arrest.

'We recognize the public's concern and interest in this matter and ask for patience as we conduct a meticulous investigation,' he stated. 'Our department is committed to upholding transparency and accountability.

Galipo plans to file a claim against the city, alleging excessive force and potential de-escalation failures.
